Terms of service

Welcome to Bayito ("the app" or "the service"), which helps you plan, equip and budget a move to a new home in Israel. Using the service means you accept these terms and our privacy policy. If you do not agree, do not use the service. Questions: bardamri1702@gmail.com.

1. What the service does

• Builds a checklist for your home and offers guides, contacts, documents, a budget and funding sources.
• Shows product prices from different shops so you can filter and compare, and keep products in a basket.
• Includes a mortgage planning and offer-comparison tool and an AI-based smart assistant.
• Runs a directory of professionals: professionals register and are verified, you contact them from the app, and those who received a service can rate and review them.

2. General information, not professional advice

• Mortgage: offers and calculations are indicative only and are not a commitment by a bank. A request is sent to a bank only after your explicit approval, and the bank decides.
• Prices: we read prices and details from shops' websites. They may be out of date, wrong or unavailable. The price and specification that count are those on the shop's site when you buy, so always check them there.
• Professionals: the directory of professionals is information only. The "verified" mark means we checked the professional's identity, business details and licence where the trade requires one, and nothing more: we do not recommend professionals and are not responsible for their work, prices or warranties. Reviews and ratings are the opinions of other users. The work, the price, the contract and the warranty are between you and the professional. Professionals marked as partners have a business relationship with us, and that is not a recommendation.
• We do not sell: you buy from the shop, under its terms. We are not a party to the sale, and warranty, delivery, returns and billing are the shop's responsibility.

3. Your account

• The service is for people aged 18 and over.
• Give correct details and keep your password and device safe. You are responsible for activity in your account. If you think someone got in, sign out other devices from "Account & security" and change your password.
• You can sign up with email or through Google, Apple or Facebook. You can delete your account at any time, as described on the deletion page.

4. Your content

• The notes, contacts and everything else you enter remain yours. You allow us to store and process them only to run the service for you, as set out in the privacy policy. Files and documents you keep in the app stay on your device and we do not store them, unless you choose to keep them with us too, and except a temporary encrypted copy of files you choose to send to a bank, as described in the privacy policy.
• Keeping documents with us is a free service you choose, up to a quota shown in the app (150 MB today). We make reasonable efforts to keep the documents safe and the service available, but do not guarantee it, so keep your own copy of important documents. We may change the quota or end the service with notice in the app in advance, and you will then be able to move the documents to your device. Do not keep content in the service that you are not allowed to hold.
• Do not upload unlawful content, or sensitive information about others without the right to do so.
• AI processing happens only if you turned it on in your account, and you can turn it off at any time.

4a. Reviews and content you publish

• You may review only a professional you contacted through the app, and only a service you actually received. Write your own experience, truthfully and fairly, about the service and not the person. One review per professional; you can edit or delete it at any time.
• Do not publish: false or misleading content, a review of a service you did not receive or under another name, defamation, abusive, threatening, racist or discriminatory content, other people's personal details (phone, address, ID number), advertising or commercial promotion, or content that breaks the law or others' rights.
• A review is shown to all users with your first name (or as "Bayito user" if you gave no name), the scores you gave and the date. The professional may reply once, and the reply is shown too. You grant us a non-exclusive licence to display the review and the reply in the service for as long as they exist.
• You are responsible for what you publish. Reviews are not checked in advance and we are not responsible for their content. Any user, and the professional, can report a review; we examine reports and may hide or remove a review that breaks these rules or the law, limit or close an account that publishes such content, and refer the matter to the authorities where the law requires. We do not remove a review only because its score is low or the professional is unhappy with it. If you come across content that you believe breaks the rules or harms you, write to us and we will handle it.
• The rating shown is the average of users' scores. The order of the list takes partnership, rating and the number of reviews into account (explained in the app), and we may change it.

4b. Professionals who join the directory

• Joining is open to anyone aged 18 and over who offers a service as a business, and it is free. You undertake to give correct and current details: name, business details and number, licences and their numbers, services and service areas, and to update them when they change. Giving a wrong detail, a licence that is not yours, or impersonating someone is a breach of these terms.
• For verification you give an ID number and upload a photo of your ID and, as needed, a dealer or company certificate and a licence. You agree that we check the details, among others against public registers (for example the contractors register, the appraisers register, the exterminators register and the Registrar of Companies). The documents and the ID number are kept encrypted, seen only by the verification team and deleted after the decision, as set out in the privacy policy.
• We decide whether to approve, reject or suspend a profile and tell you the decision, with a note where possible. Verification is not a recommendation, not a certificate of competence and not a guarantee towards customers, and must not be presented as such. We may remove from the directory a professional who breaks these terms, about whom substantiated reports were received, whose licence has expired or whose details turn out to be wrong.
• Requests from users reach you with the details they chose to share and with their consent. You may use those details only to answer that request. You may not pass them on, keep them for mailing lists or contact those people for any other purpose without their consent, in line with the Protection of Privacy Law and the Communications Law (spam).
• You alone are responsible for your work, licensing, insurance, invoices and the laws that apply to your business. We are not a party to your engagement with the customer, we do not collect payment for you and we do not promise any number of requests. The order of the list and the rating are set as described in section 4a.
• You can hide your profile for a while or delete it at any time from the app. Reviews written about you are deleted with the profile.

5. Fair use

You may not: try to get around usage limits, sign-in or permissions; scrape or copy the service automatically; test for security weaknesses without prior written permission; overload the server; write fake or paid-for reviews, rate yourself or pressure others to change a review; use the details of a request for another purpose; or harm others. Free-plan users have limits, such as a daily number of smart-assistant calls and storage space, and they may change.

6. Third-party sites

Links to shops, banks and other bodies lead to sites that are not ours. Their terms and privacy policies apply there, and we are not responsible for their content or services. Names and trademarks of shops and brands belong to their owners.

7. Availability and changes

The service is provided "as is". We try to keep it available but do not promise it will run without interruption or errors. We may change, add or stop features. If we stop the service we will give as much notice as we can and let you download your data.

8. Ending use

You can stop at any time and delete your account. We may suspend or close an account that breaks these terms or harms the service or others.

9. Limit of liability

To the extent permitted by law, we are not liable for indirect or consequential damage, loss of profit, or damage caused by relying on a price, specification, calculation or answer shown in the service. Nothing in these terms affects rights that cannot be limited by law, including consumer rights.

10. Intellectual property

The app, its design and the content we created belong to us or our licensors. You may use the service for personal use only and may not copy or distribute them without permission.

11. Governing law and courts

These terms are governed by Israeli law, and the competent courts in Israel have exclusive jurisdiction, subject to the rights the law gives consumers.

12. Changes to these terms

We will update this page when the service or the law changes and show the date at the top. We will also show a significant change in the app. Continuing to use the service after an update means you accept the new terms.
